BabyLo-তে আপনাকে স্বাগতম। BabyLo-এর ওয়েবসাইট ব্যবহার করা, ওয়েবসাইটে কোনো পণ্য দেখা অথবা কোনো পণ্য ক্রয় করার মাধ্যমে আপনি এই নিয়ম ও শর্তাবলির প্রতি সম্মতি প্রদান করছেন।
এই নিয়ম ও শর্তাবলিতে “BabyLo”, “আমরা”, “আমাদের” বলতে BabyLo-কে এবং “আপনি”, “গ্রাহক” বা “ব্যবহারকারী” বলতে ওয়েবসাইট ব্যবহারকারী বা BabyLo থেকে পণ্য ক্রয়কারী ব্যক্তিকে বোঝানো হয়েছে।
আপনি যদি এই নিয়ম ও শর্তাবলির কোনো অংশের সাথে একমত না হন, তাহলে অনুগ্রহ করে BabyLo-এর ওয়েবসাইট ব্যবহার করবেন না বা কোনো পণ্য ক্রয় করবেন না।
ভূমিকা
BabyLo প্রয়োজন অনুযায়ী যেকোনো সময় এই নিয়ম ও শর্তাবলির কোনো অংশ পরিবর্তন, সংশোধন, সংযোজন বা অপসারণ করার অধিকার সংরক্ষণ করে।
কোনো পরিবর্তন ওয়েবসাইটে প্রকাশ করার পর তা কার্যকর হবে। তাই গ্রাহকদের নিয়মিতভাবে এই পৃষ্ঠাটি পর্যালোচনা করার পরামর্শ দেওয়া হচ্ছে।

BabyLo প্রয়োজন মনে করলে কোনো হিসাব সাময়িকভাবে বন্ধ, সীমিত বা স্থায়ীভাবে বাতিল করার অধিকার রাখে।
সেবা
BabyLo-এর ওয়েবসাইটের মাধ্যমে শিশু ও বাচ্চাদের পোশাক এবং সংশ্লিষ্ট পণ্য ক্রয়ের সুবিধা প্রদান করা হয়।
ওয়েবসাইটে প্রদর্শিত পণ্যের মূল্য, আকার, রং, মজুত, বিবরণ এবং অন্যান্য তথ্য সময়ে সময়ে পরিবর্তিত হতে পারে।
কোনো পণ্য ক্রয়ের জন্য আবেদন করার মাধ্যমে আপনি প্রদর্শিত মূল্য এবং প্রযোজ্য সরবরাহ খরচসহ সংশ্লিষ্ট শর্তে পণ্যটি ক্রয় করতে সম্মতি প্রদান করছেন।

সীমিত ব্যবহার
BabyLo-এর ওয়েবসাইটে প্রকাশিত কোনো লেখা, ছবি, নকশা, প্রতীক, পণ্যের ছবি, বিবরণ বা অন্যান্য উপাদান BabyLo-এর পূর্বলিখিত অনুমতি ছাড়া অনুলিপি, পরিবর্তন, পুনঃপ্রকাশ, বিক্রয়, বিতরণ বা বাণিজ্যিকভাবে ব্যবহার করা যাবে না।

ব্যবহারকারীর আচরণ ও নিয়ম

BabyLo-এর ওয়েবসাইট বা প্রযুক্তিগত ব্যবস্থার ক্ষতি করার চেষ্টা করা।
ক্ষতিকর সফটওয়্যার, ভাইরাস বা অনুরূপ কোনো উপাদান ব্যবহার বা ছড়ানো।
অনুমতি ছাড়া ওয়েবসাইটের তথ্য সংগ্রহ বা অনুলিপি করা।
অন্য গ্রাহকের ব্যক্তিগত তথ্য সংগ্রহ বা অপব্যবহার করা।
BabyLo-এর নাম, প্রতীক, ছবি বা সৃষ্টিশীল উপাদান অনুমতি ছাড়া ব্যবহার করা।
বাংলাদেশের প্রচলিত আইন বা বিধিবিধান লঙ্ঘন করা।
প্রতারণামূলক, অসৎ, হয়রানিমূলক বা ক্ষতিকর কোনো কার্যক্রম পরিচালনা করা।
এই ধরনের কার্যক্রম শনাক্ত হলে BabyLo সংশ্লিষ্ট হিসাব বা ক্রয়ের আবেদন বাতিল, সীমিত বা স্থগিত করতে পারে।
বিশেষ ছাড় ও প্রচারণা
BabyLo সময়ে সময়ে বিশেষ ছাড়, মূল্যহ্রাস, কুপন, বিনামূল্যে সরবরাহ অথবা অন্যান্য প্রচারণামূলক সুবিধা দিতে পারে।
প্রতিটি বিশেষ সুবিধার নিজস্ব শর্ত থাকতে পারে এবং সেই শর্ত অনুযায়ী সুবিধাটি গ্রহণ করতে হবে।
একাধিক বিশেষ সুবিধা একসাথে গ্রহণ করা যাবে কি না তা সংশ্লিষ্ট প্রচারণার শর্তের ওপর নির্ভর করবে।
BabyLo প্রয়োজন অনুযায়ী কোনো বিশেষ ছাড় বা প্রচারণা পরিবর্তন, সীমিত বা বন্ধ করার অধিকার রাখে।
পণ্যের বিবরণ
BabyLo পণ্যের ছবি, বিবরণ, আকার, রং, কাপড়ের ধরন এবং অন্যান্য তথ্য যথাসম্ভব সঠিকভাবে উপস্থাপন করার চেষ্টা করে।
তবে আলোকচিত্রের আলো, আলোকসজ্জা, ক্যামেরা এবং বিভিন্ন যন্ত্রের পর্দার পার্থক্যের কারণে বাস্তব পণ্যের রং ছবিতে প্রদর্শিত রং থেকে সামান্য ভিন্ন হতে পারে।
পণ্যের মাপের ক্ষেত্রেও সামান্য পার্থক্য হতে পারে।
কোনো পণ্যের আকার, রং বা অন্যান্য বৈশিষ্ট্য সম্পর্কে নিশ্চিত হতে চাইলে ক্রয়ের আগে BabyLo-এর গ্রাহকসেবা বিভাগের সাথে যোগাযোগ করার পরামর্শ দেওয়া হচ্ছে।
তৃতীয় পক্ষের ওয়েবসাইট ও সেবা
BabyLo-এর ওয়েবসাইটে প্রয়োজনে তৃতীয় পক্ষের ওয়েবসাইট, অর্থপ্রদান ব্যবস্থা, পণ্য সরবরাহকারী প্রতিষ্ঠান বা অন্যান্য বাহ্যিক সেবার সংযোগ থাকতে পারে।
এই তৃতীয় পক্ষের ওয়েবসাইট বা সেবার বিষয়বস্তু, কার্যক্রম, নীতি বা প্রাপ্যতার ওপর BabyLo-এর সরাসরি নিয়ন্ত্রণ নেই।
তাই কোনো তৃতীয় পক্ষের সেবা ব্যবহারের আগে সংশ্লিষ্ট প্রতিষ্ঠানের নিয়ম ও গোপনীয়তা নীতি পর্যালোচনা করার পরামর্শ দেওয়া হচ্ছে।
ব্যবহারকারীর প্রকাশিত বিষয়বস্তু ও অপব্যবহার
ওয়েবসাইটে কোনো মন্তব্য, মতামত, ছবি বা অন্যান্য বিষয়বস্তু প্রকাশ করলে তার বৈধতা ও যথার্থতার জন্য সংশ্লিষ্ট ব্যবহারকারী নিজেই দায়ী থাকবেন।
অন্য কোনো ব্যক্তি বা প্রতিষ্ঠানের স্বত্বাধিকার, ব্যক্তিগত অধিকার বা আইনগত অধিকার লঙ্ঘন করে এমন কোনো বিষয়বস্তু প্রকাশ করা যাবে না।
মানহানিকর, অশালীন, প্রতারণামূলক, বেআইনি বা অনুপযুক্ত কোনো বিষয়বস্তু পাওয়া গেলে BabyLo তা অপসারণ করার অধিকার রাখে।
ক্রয় গ্রহণ ও মূল্য নির্ধারণ
কোনো পণ্য ক্রয়ের আবেদন করার পর আপনি ক্রয় নিশ্চিতকরণের বার্তা পেতে পারেন। তবে এই বার্তা পাওয়া সব ক্ষেত্রে চূড়ান্তভাবে ক্রয় গ্রহণের নিশ্চয়তা নয়।
পণ্যের মজুত না থাকা, মূল্য প্রদর্শনে ভুল, তথ্যের ত্রুটি, সরবরাহসংক্রান্ত সীমাবদ্ধতা, সন্দেহজনক কার্যক্রম বা অন্য কোনো যুক্তিসঙ্গত কারণে BabyLo কোনো ক্রয় গ্রহণ, পরিবর্তন বা বাতিল করতে পারে।
ওয়েবসাইটে প্রদর্শিত পণ্যের মূল্য পরিবর্তিত হতে পারে।
কোনো পণ্যের মূল্য ভুলভাবে প্রদর্শিত হলে BabyLo সংশ্লিষ্ট ক্রয় যাচাই অথবা বাতিল করার অধিকার রাখে।
পণ্য পরিবর্তন ও ফেরত
BabyLo-এর নির্ধারিত নীতিমালা অনুযায়ী যোগ্য পণ্যের ক্ষেত্রে পরিবর্তনের সুবিধা প্রদান করা হতে পারে।
পরিবর্তন বা ফেরতের জন্য পণ্য অবশ্যই নির্ধারিত অবস্থায় থাকতে হবে। ব্যবহৃত, ধোয়া, ক্ষতিগ্রস্ত বা পরিবর্তিত পণ্য পরিবর্তন বা ফেরতের জন্য গ্রহণযোগ্য নাও হতে পারে।
পণ্যের মূল মোড়ক, ট্যাগ এবং সংশ্লিষ্ট অন্যান্য উপাদান অক্ষত রাখা প্রয়োজন হতে পারে।
ভুল আকার নির্বাচন বা ব্যক্তিগত পছন্দ পরিবর্তনের কারণে পণ্য পরিবর্তনের ক্ষেত্রে প্রযোজ্য সরবরাহ বা ফেরত খরচ গ্রাহককে বহন করতে হতে পারে।
ভুল, ত্রুটিপূর্ণ বা ক্ষতিগ্রস্ত পণ্য পাওয়া গেলে BabyLo বিষয়টি যাচাই করে প্রযোজ্য সমাধান প্রদান করবে।

অর্থ ফেরত
যে ক্ষেত্রে প্রযোজ্য, BabyLo-এর নির্ধারিত ফেরত নীতিমালা অনুযায়ী অর্থ ফেরত দেওয়া হবে।
অর্থ ফেরতের আগে ক্রয়সংক্রান্ত তথ্য, পণ্যের অবস্থা এবং অন্যান্য প্রয়োজনীয় বিষয় যাচাই করা হতে পারে।
অর্থ ফেরতের সময় ব্যবহৃত অর্থপ্রদানের পদ্ধতি এবং সংশ্লিষ্ট আর্থিক প্রতিষ্ঠানের কার্যক্রমের ওপর নির্ভর করতে পারে।
সরবরাহ খরচ বা অন্যান্য সেবাসংক্রান্ত খরচ সব ক্ষেত্রে ফেরতযোগ্য নাও হতে পারে।
ক্রয় বাতিল
পণ্য প্রেরণের পূর্বে গ্রাহক ক্রয় বাতিলের অনুরোধ করতে পারেন।
তবে ক্রয় প্রক্রিয়ার নির্দিষ্ট পর্যায় অতিক্রম করার পর অথবা পণ্য প্রেরণ হয়ে গেলে বাতিলের অনুরোধ গ্রহণ করা সম্ভব নাও হতে পারে।
বারবার ভুয়া ক্রয়, প্রতারণামূলক কার্যক্রম, ভুল তথ্য বা ইচ্ছাকৃতভাবে পণ্য গ্রহণ না করার মতো ঘটনা ঘটলে BabyLo সংশ্লিষ্ট ক্রয় বাতিল করতে এবং ভবিষ্যৎ ক্রয়ের সুবিধা সীমিত করতে পারে।
স্বত্বাধিকার ও সৃষ্টিশীল অধিকার
BabyLo-এর নাম, প্রতীক, ওয়েবসাইটের নকশা, লেখা, ছবি, পণ্যের ছবি, চিত্র এবং অন্যান্য সৃষ্টিশীল উপাদান BabyLo অথবা সংশ্লিষ্ট স্বত্বাধিকারীর সম্পত্তি।
পূর্বলিখিত অনুমতি ছাড়া এসব উপাদান অনুলিপি, পুনঃপ্রকাশ, পরিবর্তন, বিতরণ বা বাণিজ্যিকভাবে ব্যবহার করা যাবে না।
অননুমোদিত অর্থপ্রদান
আপনার অর্থপ্রদানের হিসাবে BabyLo-এর নামে কোনো অচেনা বা অননুমোদিত লেনদেন দেখতে পেলে প্রথমে আপনার পরিবারের সদস্য বা আপনার পক্ষ থেকে ক্রয় করতে পারেন এমন ব্যক্তিদের সাথে বিষয়টি যাচাই করুন।
লেনদেনটি আপনার পরিচিত না হলে যত দ্রুত সম্ভব BabyLo-এর গ্রাহকসেবা বিভাগের সাথে যোগাযোগ করুন, যাতে বিষয়টি যাচাই করা যায়।
ক্ষতিপূরণ
আপনার এই নিয়ম ও শর্তাবলি লঙ্ঘন, প্রতারণামূলক কার্যক্রম, বেআইনি ব্যবহার বা ওয়েবসাইটের অপব্যবহারের কারণে BabyLo-এর কোনো ক্ষতি, দাবি, ব্যয় বা দায় সৃষ্টি হলে প্রযোজ্য আইন অনুযায়ী আপনি তার জন্য দায়ী হতে পারেন।
ক্ষতির ঝুঁকি
পণ্য গ্রাহকের কাছে যথাযথভাবে হস্তান্তর না হওয়া পর্যন্ত পণ্যের নিরাপদ সরবরাহের দায়িত্ব BabyLo এবং সংশ্লিষ্ট সরবরাহ ব্যবস্থার ওপর থাকবে।
গ্রাহকের কাছে পণ্য যথাযথভাবে হস্তান্তর হওয়ার পর পণ্যের সংরক্ষণ ও ব্যবহারের দায়িত্ব গ্রাহকের ওপর বর্তাবে।
জালিয়াতি প্রতিরোধ নীতি
গ্রাহক ও BabyLo-এর নিরাপত্তা নিশ্চিত করার জন্য সন্দেহজনক বা প্রতারণামূলক কার্যক্রম শনাক্ত করতে বিভিন্ন যাচাই ব্যবস্থা গ্রহণ করা হতে পারে।
কোনো ক্রয় অস্বাভাবিক বা সন্দেহজনক মনে হলে BabyLo অতিরিক্ত তথ্য যাচাই করতে পারে অথবা সংশ্লিষ্ট ক্রয় সাময়িকভাবে স্থগিত বা বাতিল করতে পারে।
দায়বদ্ধতার সীমাবদ্ধতা
BabyLo ওয়েবসাইটের তথ্য যথাসম্ভব নির্ভুল ও হালনাগাদ রাখার চেষ্টা করে। তবে সব সময় ওয়েবসাইট সম্পূর্ণ ত্রুটিমুক্ত বা নিরবচ্ছিন্ন থাকবে—এমন নিশ্চয়তা দেওয়া হয় না।
ওয়েবসাইট ব্যবহারের কারণে প্রত্যক্ষ নয় এমন কোনো ক্ষতির জন্য প্রযোজ্য আইন দ্বারা অনুমোদিত সীমার মধ্যে BabyLo দায়ী থাকবে না।
তবে এই নিয়ম ও শর্তাবলির মাধ্যমে বাংলাদেশের প্রচলিত আইনে গ্রাহকের কোনো বাধ্যতামূলক অধিকার অযৌক্তিকভাবে সীমিত করা হচ্ছে না।
প্রাকৃতিক ও অনিয়ন্ত্রিত পরিস্থিতি
প্রাকৃতিক দুর্যোগ, বন্যা, ঘূর্ণিঝড়, অগ্নিকাণ্ড, মহামারি, যুদ্ধ, ধর্মঘট, সরকারি বিধিনিষেধ, সরবরাহকারী প্রতিষ্ঠানের সমস্যা, ইন্টারনেট সমস্যা, প্রযুক্তিগত ত্রুটি বা BabyLo-এর যুক্তিসঙ্গত নিয়ন্ত্রণের বাইরে থাকা কোনো কারণে সেবা বা পণ্য সরবরাহে বিলম্ব হলে তার জন্য BabyLo সরাসরি দায়ী থাকবে না।
পরিস্থিতি স্বাভাবিক হলে BabyLo যথাসম্ভব দ্রুত স্বাভাবিক কার্যক্রম চালু করার চেষ্টা করবে।
প্রযোজ্য আইন
এই নিয়ম ও শর্তাবলি বাংলাদেশের প্রচলিত আইন অনুযায়ী পরিচালিত ও ব্যাখ্যা করা হবে।
BabyLo এবং কোনো গ্রাহকের মধ্যে বিরোধ দেখা দিলে প্রথমে পারস্পরিক আলোচনার মাধ্যমে বিষয়টি সমাধানের চেষ্টা করা হবে।
আলোচনার মাধ্যমে সমাধান সম্ভব না হলে বাংলাদেশের প্রযোজ্য আইন অনুযায়ী উপযুক্ত আদালতের এখতিয়ার প্রযোজ্য হবে।
বিরোধ নিষ্পত্তি
কোনো অভিযোগ বা বিরোধ দেখা দিলে গ্রাহককে প্রথমে BabyLo-এর সাথে সরাসরি যোগাযোগ করে বিষয়টি সমাধানের সুযোগ দেওয়া হবে।
BabyLo গ্রাহকের অভিযোগ যথাসম্ভব দ্রুত এবং ন্যায্যভাবে সমাধানের চেষ্টা করবে।
প্রয়োজনে উভয় পক্ষ পারস্পরিক সম্মতির ভিত্তিতে বিকল্প বিরোধ নিষ্পত্তির পদ্ধতি গ্রহণ করতে পারে।
সমাপ্তি
BabyLo যদি যুক্তিসঙ্গতভাবে মনে করে যে কোনো ব্যবহারকারী এই নিয়ম ও শর্তাবলি লঙ্ঘন করেছেন, ওয়েবসাইটের অপব্যবহার করেছেন, প্রতারণামূলক কার্যক্রম পরিচালনা করেছেন অথবা বেআইনি কোনো কাজে ওয়েবসাইট ব্যবহার করেছেন, তাহলে BabyLo তার ওয়েবসাইট ব্যবহারের সুবিধা বা হিসাব সাময়িকভাবে স্থগিত বা স্থায়ীভাবে বন্ধ করতে পারে।
কোনো হিসাব বন্ধ হলেও সেই সময়ের পূর্বে সম্পন্ন হওয়া বৈধ ক্রয়ের ক্ষেত্রে প্রযোজ্য অর্থপ্রদানের দায়বদ্ধতা বহাল থাকবে।
নিয়ম ও নীতিমালার হালনাগাদ
BabyLo যেকোনো সময় এই নিয়ম ও শর্তাবলি এবং সংশ্লিষ্ট নীতিমালা পরিবর্তন বা হালনাগাদ করার অধিকার রাখে।
হালনাগাদ করা নিয়ম ও শর্তাবলি ওয়েবসাইটে প্রকাশ করার পর কার্যকর হবে।
